Requesting a review is free and creates no obligation to sell. Nothing on this website is a binding offer. A purchase is only binding when you sign a written purchase agreement.

Please read these terms. If you do not agree with them, do not use the website.

1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of humbersidecapital.ca (the "Website") and any forms, consultations, or communications offered through it. By using the Website or submitting a request, you agree to these Terms and to our Privacy Policy.

These Terms apply to the Website only. Any purchase agreement you sign with us is a separate contract, and if there is a conflict, the signed agreement prevails.

2. Who we are

Humberside Capital ("Humberside Capital", "we", "us") represents a group of vetted investors and development partners and acquires residential and land properties across Ontario, Canada. We may purchase a property directly or assign our purchase agreement to a partner buyer.

Unless we agree otherwise in writing, we are acting as a buyer or as a representative of the buyer, and we are not acting as your real estate agent, broker, lawyer, or advisor.

3. Property reviews and consultations

  • Reviews and initial consultations are free and carry no obligation for either side.
  • You agree that the information you provide about yourself and your property is accurate and complete to the best of your knowledge, and that you have the authority to discuss and sell the property (for example, as owner or authorized representative).
  • If you co-own the property, any sale may require the agreement of all owners. Others with an interest, such as a lender or tenant, may also affect a sale.
  • We may decline to make an offer for any reason, and we may change or withdraw a preliminary figure if the information provided turns out to be incomplete or inaccurate, or if inspections or title searches reveal new facts.
  • Response times mentioned on the Website are estimates, not guarantees.

4. Offers, valuations, and assignment

Offers are not appraisals

Any figure we discuss is a purchase offer, not a formal appraisal or an opinion of market value. Our offers reflect our own investment criteria and may be lower than the price you could achieve on the open market. You are encouraged to compare our offer against other options, including a market evaluation from a licensed real estate professional or an independent appraisal.

Purchase agreements

No sale is binding until you and we sign a written purchase agreement. We may offer a purchase price, conditions, deposit, and closing date in that agreement. Please read it carefully before signing.

Assignment to a partner buyer

We may assign our rights under a purchase agreement to a partner buyer. If assignment is part of a transaction, the right to assign is stated in the agreement and we will explain it before you sign. We may receive a fee or profit from an assignment.

5. No legal, financial, or tax advice

Information on the Website and from our team is general in nature and is not legal, financial, tax, or real estate advice. We strongly recommend that you obtain independent legal advice before signing any agreement, and speak with your own financial or tax advisor about the effect of a sale on your situation. You may take as much time as you need to do so.

6. Your information

When you submit information through the Website, you give us permission to use and share it as described in our Privacy Policy, including with partner buyers and service providers where needed for a transaction. Please do not submit information about other people unless you are authorized to do so.

7. Communications and consent

By submitting a form or contacting us, you consent to be contacted by phone, text message, and email about your request and our services. Message and data rates may apply. You can opt out at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us directly.

8. Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent information, or submit a property you have no right to sell
  • Use the Website for unlawful purposes or in violation of any applicable law
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Website or its systems
  • Use automated tools to scrape, copy, or submit bulk or spam requests
  • Impersonate another person or misrepresent your relationship with a property

We may block access or refuse service to anyone who breaks these rules.

9. Intellectual property

The Website and its content, including text, design, logos, and graphics, belong to Humberside Capital or its licensors and are protected by copyright and trademark law. You may view the Website for your personal use, but you may not copy, modify, distribute, or reuse its content without our written permission.

10. Third-party links and services

The Website may link to or embed third-party services, such as booking tools and forms. We do not control and are not responsible for third-party content or practices, and your use of those services is subject to their own terms and policies.

11. Disclaimers

The Website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we do not guarantee that the Website will be uninterrupted, error-free, or secure, or that its content is complete, current, or suitable for your needs. We make no promise that you will receive an offer or that a transaction will close.

12. Limitation of liability

To the fullest extent permitted by law, Humberside Capital and its owners, partners, employees, and agents are not liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or opportunity, arising from your use of the Website. Our total liability relating to the Website will not exceed one hundred Canadian dollars (CAD $100).

This section applies to your use of the Website only. It does not limit rights you may have under a signed purchase agreement or any rights that cannot be limited by law.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree that the courts of Ontario have jurisdiction over any dispute arising from these Terms or your use of the Website, unless the law requires otherwise.

14. Changes to these terms

We may update these Terms from time to time. The "Last updated" date shows when they were last revised. Your continued use of the Website after changes are posted means you accept the updated Terms. If any part of these Terms is found to be unenforceable, the rest will continue to apply.
