We only ask for what we need to review your property and talk with you about your options. We do not sell your personal information, and we do not list your property on MLS or advertise it publicly. If we work toward a sale, we may share property details privately with prospective partner buyers, as explained in section 5.

1. Overview

Humberside Capital ("Humberside Capital", "we", "us", "our") is a real estate acquisitions business serving homeowners across Ontario, Canada. This Privacy Policy explains how we handle personal information collected through humbersidecapital.ca (the "Website"), our forms, and our communications with you.

We handle personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and Canada's Anti-Spam Legislation (CASL).

Humberside Capital represents a group of vetted investors and development partners. We may purchase a property directly or assign our purchase agreement to a partner buyer. This is why some information may be shared with those partners, as described in section 5.

2. Information we collect

Information you give us

When you submit a property review request, book a consultation, email us, or call us, we may collect:

  • Your name, email address, and phone number
  • Your property address and details (type, condition, occupancy, mortgage or ownership information you choose to share)
  • Your timeline and reasons for considering a sale
  • Details of our communications with you, including call notes and messages
  • Any documents or information you voluntarily send us

Information collected automatically

When you visit the Website, we and our service providers may automatically collect your IP address, browser and device type, pages viewed, referring website, and the date and time of your visit. See section 7.

Please do not send us sensitive information we do not need, such as Social Insurance Numbers, banking details, or government ID, unless we specifically ask for it as part of a transaction.

3. How we use your information

  • To respond to your request and review your property
  • To contact you about your options, schedule consultations, and make or discuss purchase offers
  • To prepare and complete agreements and related transaction steps, if you choose to proceed
  • To share property details with prospective partner buyers, and with the assignee where assignment is part of a transaction (see section 5)
  • To operate, secure, and improve the Website and our services
  • To send you follow-up or marketing messages about our services, where you have consented or the law otherwise permits
  • To meet legal, tax, and regulatory obligations and to protect our rights

4. Consent

We collect, use, and disclose your personal information with your consent, which may be express (for example, submitting a form) or implied where the law allows. By submitting your information through the Website, you consent to its use as described in this policy.

You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us using the details in section 13. Withdrawing consent may mean we can no longer continue to review your property or communicate with you about it.

5. Who we share it with

We do not sell your personal information. We share it only as needed to provide our services:

  • Prospective partner buyers. Once you have signed a purchase agreement with us, we may share details about the property, such as its address, photos, condition, and price, privately with investors and development partners in our network to find a buyer for the agreement. We do not share your name or contact information with prospective buyers at this stage unless you agree.
  • The assignee. If we assign our purchase agreement, we share your name, property details, and the agreement terms with the assignee so the transaction can be completed. Any right to assign is stated in the purchase agreement before you sign.
  • Service providers. Companies that help us operate, such as our customer relationship management, form, scheduling, email, text messaging, calling, website hosting, and website security providers (including HighLevel / LeadConnector, which powers our forms and communications).
  • Professional advisors and transaction parties. Real estate lawyers, title and closing professionals, accountants, and other advisors involved in a transaction.
  • Legal and safety reasons. Where required by law, court order, or a regulator, or to protect our rights, property, or safety.
  • Business changes. If our business is sold, merged, or restructured, your information may be transferred to the successor, who must protect it consistent with this policy.

6. Calls, texts & email

If you submit a form or contact us, we may contact you by phone, text message, and email about your request. We will send you other marketing messages about our services only where you have given express consent or where CASL otherwise permits. Message and data rates may apply to texts. You can unsubscribe at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us directly. We will honour requests promptly and in any event within the timeframes required by CASL.

Every commercial email we send identifies us and includes our contact information and an unsubscribe mechanism. If your number is on the National Do Not Call List, we will contact you only where permitted by law, such as where you have made an inquiry or given consent.

7. Cookies & analytics

The Website and our service providers may use cookies and similar technologies to keep the site working, understand how visitors use it, measure marketing performance, and remember your preferences. 8. Storage & security

We use reasonable physical, technical, and administrative safeguards to protect personal information, including access controls and encrypted connections. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Our service providers may store or process information on servers outside Canada, including in the United States. Information held in another country may be accessible to courts, law enforcement, and authorities there under that country's laws.

9. Retention

We keep personal information only as long as needed for the purposes described in this policy, to resolve disputes, and to meet legal, tax, and accounting requirements. When it is no longer needed, we securely delete or anonymize it.

10. Your rights

Subject to applicable law, you may:

  • Ask what personal information we hold about you and how it has been used and shared
  • Request correction of information that is inaccurate or incomplete
  • Withdraw your consent or ask us to stop contacting you
  • Ask us to delete your information, where we are not required to keep it

To make a request, contact us using the details below. We may need to verify your identity first, and we will respond within the time required by law. If you are unhappy with how we handle your information, you may also contact the Office of the Privacy Commissioner of Canada.

11. Children

Our Website and services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with information, contact us and we will delete it.

12. Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top shows when it was last revised. Material changes will be posted on this page, and your continued use of the Website after changes are posted means you accept the updated policy.
